A whole new MDS assessment is on the way - some items remain the same, many are there but different, and several new areas have been added. The draft MDS 3.0 is now being tested in SNFs. Steps along the way to a final form include town hall meetings for public comment, pilot and national validation tests, and release of a final draft.

Major changes in MDS 3.0 include:
  • Combining Sections AA, AB, and A into on new Section A with 14 items


  • Adding a self-report that uses the 5-item GDS in E1b: Indicators of Possible Depression, Sad Mood


  • Adding a new F1: Self-Report Quality of Life that is to be coded only for residents with OK memory. The current F1 and F3 were moved to Section N


  • Adding drop-down menus to include specific ICD-9 codes in Section I. The contents of the menu are shown on pages 13-20 of the draft


  • Changing Section J to Health Conditions - the only unchanged item is J5. These items are new: J2 - Pain Assessment, J3 - Pain Management, and J4 - Number and Classification of Falls


  • Changing K1 - Oral Problems to Swallowing and Nutritional Status with ASHA as the source


  • Replacing current M1 - Ulcers with Staging Pressure Ulcers, recommended by NPUAP


  • Adding P7 - Expected Length of Stay, for residents in a Medicare stay and only for 5-day and readmission assessments


  • Changing RAPs: the draft calls for 21 RAPs instead of the current 18. Some current RAPs have been combined, and six have been added: Pressure Ulcer Prevention, Quality of Life, Restorative Care, Discharge Planning, Pain, and Infection Control/Prevention

Quickly following the deadline of April 14, 2003 for the HIPAA Privacy Standards is the next HIPAA Transaction Standards compliance date. Beginning April 15, 2003, providers are to begin testing electronic transactions, such as claims, in the HIPAA format.

Note to VistaKEANE Clients

VistaKEANE Resident Account Management and VistaCARE Accounts Receivable software were certified by Claredi for Outbound ANSI 837 Institutional Health Care Claims, Version 004010x096 in October 2002.

This certification means that the software is capable of generating HIPAA compliant outbound claims for your trading partners who are Claredi certified. CMS requires that all its Medicare contractors (intermediaries) test with Claredi.

The VistaKEANE RAM 2.2 update with 837 capability was released in 2002. The VistaCARE Accounts Receivable 2.x update for 837 will be released in April 2003.

Keane Care continues to test with intermediaries and strongly recommends clients test the software with their trading partners to verify their data in the new format.

The Final Rule for the HIPAA Security Standards was published in the Federal Register of February 20, 2003. The compliance date for providers is April 20, 2005.

The HIPAA Security Rule defines safeguards to protect the confidentiality, integrity, and availability of electronic protected health information. Providers are required to protect electronic protected health information from unauthorized access, alteration, deletion, and transmission.

Entities covered by the HIPAA Security Rule are health plans, clearinghouses, and healthcare providers that maintain or transmit health information electronically. The Rule makes no distinction between internal corporate communication and communication external to the corporation.

The proposed Security Rule published in 1998 included electronic signatures. The 2003 Rule states that the standard for electronic signature will be published later.

Does the HIPAA Privacy Rule permit nursing homes to disclose information concerning admissions of supplemental security income (SSI) recipients to the Social Security Administration (SSA)?

Yes. SSA requires nursing homes, extended care facilities, and intermediate care facilities to report to SSA, within 2 weeks, admissions information about anyone receiving SSI who is admitted to the institution. The purpose is to prevent SSI overpayments caused by a SSI recipient's failure to timely report changes in eligibility.
